Lexington County Council approved the first reading of two ordinances (23-14 and 23-15) during their regularly scheduled council meeting on Tuesday, Oct. 10. These ordinances relate to concurrency requirements for various residential-type developments and residential subdivisions in the unincorporated areas of Lexington County. "Concurrency" is a shorthand expression for a set of land use regulations that local governments adopt to ensure that adequate public services are available to support the new development.

In regards to the pending ordinances, please reference the following information regarding plan review and submittals:
• The County of Lexington will continue to accept all projects for plan review. County staff, not the developer, will coordinate with all applicable stakeholders (Law Enforcement, Fire Services, Emergency Medical Services, Solid Waste Management, Public School Districts) during the review process to ensure the concurrency requirements are met.
• County staff will be advising potential developers during the Development Review Meeting (DRM) process of this requirement moving forward. Please note, since this is a pending ordinance, previous projects in which a DRM was held but have not been formally submitted, now must conform to the pending ordinances.
• For land disturbance applications, fees are necessary at the time of submittal; however, the fees will not be deposited until confirmation that the concurrency standards are met.
• Concurrency must be received from all stakeholders prior to continuing the approval and permitting process.
Projects that were formally submitted prior to October 10, 2023, are not affected by the pending ordinance. The pending ordinances do not apply to projects located within municipalities.
